(Excerpt)The development of global environmental challenges urged the emergenceof a new generation of environmental law that promotes inclusiveness, a systemic approach and mutualisation of resources and responsibility.Indeed, human activities profoundly impact natural processes, so that natural changesexperienced nowadays are mainly human-driven. This strong anthropogenicforce over nature led to a new era, named the Anthropoceneand characterised by unprecedented, rapid and uncertain changes in the environment. Underthe Anthropocene, the existing normative and institutional framework isseriously challenged. It calls for a paradigm shift. This paradigm shift is to begrounded upon the existing framework by emphasising the need to protect theenvironment as a shared concern. This is, for example, the case with regard tothe protection and conservation of the marine environment and its resources.
